High Court Declares COVID-19 Level 3 & 4 Lockdown Regulations Unconstitutional & Invalid

The North Gauteng High Court has declared the Level 3 and Level 4 COVID-19 lockdown regulations unconstitutional and invalid.

While the court has ruled that Cooperative Governance and Traditional Affairs Minister of Nkosazana Dlamini-Zuma has 14 days to formulate changes to the regulations, alert level 3 regulations will remain in operation for now.

News24 reports that the judgment said the government has not produced any bona fide evidence that its means of enforcing the lockdown are “justifiable”, and they can therefore be deemed arbitrary and unlawful.

It says the lockdown regulations go against rights enshrined in the Bill of Rights.

Cabinet says that it would make further statements once it had fully studied the judgment.
