[LISTEN] Public Protector Dealt Decisive Blow in Court over Gordhan ‘Rogue Unit’ Report

The Organisation Undoing Tax Abuse’s (Outa) head of legal affairs, Stefanie Fick says the Gauteng High Court has affirmed that the issue surrounding the so-called SARS “rogue unit” was out of proportion and untrue.

Public Protector Busisiwe Mkhwebane was dealt a decisive blow in the Gauteng High Court on Monday.

Three high court judges described the course of her investigation into Pravin Gordan and a so-called SARS “rogue unit” as being without foundation, particularly as the conclusions in her report, was based on discredited reports and unsubstantiated facts.

Speaking to Radio Islam, Fick says the Nugent Commission, the Kroon Commission, a KPMG report and the Zondo Commission, put the so-called SARS “rogue unit” to rest.

“This whole thing about the rogue unit was out of proportion and it wasn’t true, that the rogue unit came from the Sunday Times who also apologised. It was a sort of a chess game by people inside of Sars because what was the consequence is that people were fired and that specific unit couldn’t do their work.”

Fick says Mkhwebane was adamant to pursue the SARS Rogue unit.

“She than went against all the recent findings and said there was a rogue unit. That was part of the court’s judgement is to say this is irrational and it’s not based on fact.”

Mkhwebane was dealt a further blow when the court order her to pay 15% of the court’s costs.
