Ramaphosa May Face Legal Challenge if He Doesn’t Sack Gigaba – CFCR

The Centre for Constitutional Rights says President Cyril Ramaphosa will be opening himself up to a legal challenge if he doesn’t fire home affairs minister Malusi Gigaba.

Gigaba has been mired in controversy and in one week not only faced the scandal surrounding a leaked sex tape, but was found to be a liar by Constitutional Court and the Public Protector.

And his problems are far from over – This week he will have to face the portfolio committee on home affairs on the judgment against him on the Fireblade Aviation saga and the findings of the public protector.

With calls growing for his removal, the Director of the Centre for Constitutional Rights, Phephelaphi Dube says Ramaphosa must take action against Gigaba.

“The president is going to open himself up to a legal challenge if he doesn’t act because it would be arguably irrational to continue keeping Minister Gigaba in that position given what the court and important institutions like the Chapter Nine Institution, the public protector has already said about the minister.”

Dube says legally Gigaba is very much “at the end of the road” and doesn’t seem to have any more legal recourse to pursue the matter.
