\ud83d\udcf8 ICC Holds Firm: Despite mounting global pressure, the International Criminal Court refuses to halt arrest warrants for Benjamin Netanyahu and Yoav Gallant, reinforcing calls for accountability over alleged war crimes.<\/p><\/div>\n

The International Criminal Court (ICC) has dismissed Israel\u2019s attempt to halt arrest warrants for Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant, escalating diplomatic fallout with powerful allies including the United States and European Union.<\/p>\n

The decision underscores the ICC\u2019s determination to uphold the rule of law despite what international law expert Professor Hennie Strydom called \u201cbullying tactics by both Israel and the United States.\u201d Speaking to Radio Islam International<\/a><\/em>, Strydom emphasised that arrest warrants issued by the ICC are legally binding on all signatories to the Rome Statute. \u201cThere is an obligation under the Rome Statute determining that states, must cooperate with the court,\u201d he explained.<\/p>\n

Israel has argued that the ICC lacks jurisdiction over the Gaza conflict, but Strydom firmly dismissed this: \u201cIt\u2019s been determined a long time ago, that it has jurisdiction over the occupied territories including Gaza. There\u2019s no basis for [Israel\u2019s] argument. It has no basis in law.\u201d<\/p>\n

Of particular concern are threats reportedly directed at ICC Prosecutor Karim Khan. Strydom warned that such actions \u201cseriously undermine the court and international justice,\u201d and reflect a dangerous precedent of political intimidation. \u201cThey\u2019ve done it before, especially the United States,\u201d he added.<\/p>\n

While the ICC can issue arrest warrants, it lacks an enforcement arm, relying instead on state cooperation. \u201cIf [member states] do not comply, there\u2019s nothing the court itself can do,\u201d said Strydom. However, non-compliance can be challenged through diplomatic means at the annual Assembly of States Parties, which he said could \u201cexert pressure to change the conduct we see developing now.\u201d<\/p>\n

Sanctions related to ICC rulings also carry personal consequences. Targeted individuals may face travel restrictions and financial complications. \u201cThey\u2019re placed on a screening mechanism applicable to all banks,\u201d Strydom noted, making international movement and banking difficult.<\/p>\n

As global tension mounts, concerns are growing about the ICC\u2019s long-term viability. \u201cIf this continues, the court may become totally ineffective,\u201d Strydom warned, stressing the institution\u2019s role in providing justice when domestic systems fail.<\/p>\n

\u201cIf that court fails, victims of armed conflict will not be able to find a remedy,\u201d he concluded.<\/p>\n

The ICC\u2019s resolve is being put to the test. Whether international justice can withstand such political pressure remains to be seen.<\/p>\n
