Image credits: Daily Sun<\/p><\/div>\n<p>A legal showdown is brewing at the Constitutional Court as Jacob Zuma\u2019s MK Party challenges President Cyril Ramaphosa\u2019s decision to suspend Police Minister Senzo Mchunu and appoint law professor Feroz Kachalia as acting minister, all while launching a judicial commission of inquiry.<\/p>\n<p>The matter, described by Legal Analyst Mpumelelo Zikalala as unprecedented, raises sharp constitutional and procedural questions. At the heart of the dispute is whether the president acted lawfully by keeping Mchunu on special leave with all the benefits of office, while simultaneously appointing another minister to act in his place.<\/p>\n<p>\u201cThe Constitutional Court is the apex court,\u201d explained Zikalala in an interview with <a href=\"https:\/\/soundcloud.com\/radioislam\/zumas-mk-party-takes-ramaphosa-to-constitutional-court-over-police-minister-suspension?si=dbb357bb9c6a4ba6984da57a3af41b75&amp;utm_source=clipboard&amp;utm_medium=text&amp;utm_campaign=social_sharing\"><em>Radio Islam International<\/em>.<\/a> \u201cIt has jurisdiction in matters of great public importance or where bypassing lower courts avoids wasting time.\u201d<\/p>\n<p>Zikalala pointed to the MK Party\u2019s core argument: \u201cThe president is not allowed to put a minister on special leave and then employ an acting minister while that minister still continues to enjoy the perks.\u201d On the other hand, Ramaphosa\u2019s supporters argue that \u201cthe president has unilateral decision-making powers when it comes to hiring and firing members of his cabinet.\u201d<\/p>\n<p>But this situation is far from straightforward. Zikalala notes, \u201cThere\u2019s no precedent for this. It\u2019s a first for the courts.\u201d The critical issue, he says, lies in the rationality of having \u201ctwo ministers being paid and serving in the same position. Why not reassign the suspended minister or remove him entirely?\u201d<\/p>\n<p>He emphasized that presidential decisions must meet three key criteria: \u201cThey must be lawful, rational, and procedurally fair.\u201d A failure in any of these opens the door for judicial intervention.<\/p>\n<p>The court has already indicated urgency in the matter. \u201cAn interim ruling (Part A) may be issued by the first or second week of August,\u201d Zikalala said.
