The Constitutional Court has ordered the African National Congress (ANC) to hand over all records related to cadre deployment during President Cyril Ramaphosa’s tenure as chairperson of the Deployment Committee. The ruling comes after the court dismissed the ANC’s appeal against an earlier order mandating the disclosure of the documents to the Democratic Alliance (DA).

The records in question encompass minutes of meetings, WhatsApp conversations, email threads, CVs, and other pertinent materials dating back to 2013 when President Ramaphosa assumed leadership of the Cadre Deployment Committee.

The DA cites transparency and accountability as reasons for the court process, as it attempts to disclose the alleged interference in appointment processes that facilitated state capture and corruption.

DA Member of Parliament Leon Schreiber discussed the matter on Radio Islam International, reiterating the importance of transparency in addressing systemic issues in South Africa.

“We know from the Zondo Commission that the Cadre Deployment Committee interferes with appointment processes, and so ultimately we need transparency around how they interfere and how they appointed these ANC cadres who have essentially captured the state and collapse the services around us,” Schreiber said.

Despite the court’s directive, the ANC has remained silent, with only a brief tweet stating their intention to study the judgment. However, time is of the essence as the clock ticks down on the five-day deadline set by the court. Failure to comply would not only constitute contempt of court but could also trigger a constitutional crisis.

Observers speculate on the ANC’s next move, questioning whether they will find a legal loophole, comply with the order, or risk facing consequences for non-compliance.

The outcome of this decision holds significant implications for the ANC leadership, particularly President Ramaphosa, whose involvement during his tenure as chairperson of the Cadre Deployment Committee could be exposed.
